Notice of Passing - Comprehensive Zoning By-law

NOTICE OF THE PASSING OF A NEW COMPREHENSIVE ZONING BY-LAW

By-law No. 2026-088

TAKE NOTICE that the Council of the Corporation of the Municipality of Grey Highlands passed By-law No. 2026-088 on September 16, 2026, under Section 34 of the Planning Act, R.S.O. 1990, c. P.13.

THE PURPOSE AND EFFECT of By-law No. 2026-088 is to repeal and replace Comprehensive Zoning By-law 2004-50, as amended, with a new Comprehensive Zoning By-law applying to all lands within the Municipality of Grey Highlands. The by-law establishes new zone categories, zone boundaries and zoning schedules, and new general provisions, definitions and zone-specific regulations governing the use of land and the erection, location and use of buildings and structures. Because the by-law applies to all lands in the Municipality, no key map of subject lands is provided; the zoning schedules forming part of the by-law are available for review as noted below.

WHEN THE BY-LAW TAKES EFFECT: By-law No. 2026-088 was passed in the circumstances described in subsection 24 (2) of the Planning Act and does not come into force on the day it was passed. It comes into force only when Official Plan Amendment No. 51 is approved by the County of Grey and comes into effect. Zoning By-law 2004-50, as amended, remains in full force and effect until that time.

ANY OF THE FOLLOWING may appeal By-law No. 2026-088 to the Ontario Land Tribunal by filing a notice of appeal with the Clerk of the Municipality of Grey Highlands not later than October 12, 2026: the Minister of Municipal Affairs and Housing; a specified person (as defined in subsection 1 (1) of the Planning Act) who made oral submissions at a public meeting or written submissions to Council before the by-law was passed; a public body that made such submissions; and the registered owner of any land to which the by-law applies who made such submissions. The notice of appeal must set out the objection to the by-law and the reasons in support of the objection and must be accompanied by the fee required by the Ontario Land Tribunal.

NO PERSON OR PUBLIC BODY shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to Council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

THE LANDS to which the by-law applies are also the subject of Official Plan Amendment No. 51, adopted by Council on September 16, 2026, and submitted to the County of Grey for approval.
